Terms and Conditions
1) General
All deliveries and accomplishments are based upon these general terms and conditions. Please view the product description for all the details regarding our offerings. All offerings are not binding and are subject to changes. In addition, special terms (please view attachment A) is valid for all rentals offered in the shop. The terms of business are valid for all orders made online, via telephone or in person. Any translation of the English version of this Agreement is provided for convenience only and only the German version shall be legally binding.
2) Terms of use and copyright
The information on this website is carefully controlled and updated regularly. Despite all carefulness, changes in data can occur. There is no liability or guarantee for the actuality, correctness, and completeness of the given information. All information is subject to changes and corrections. The access and use of the website incl. all information is subject to the user’s own liability. The same is valid for all other websites that are mentioned. Furthermore, we do not have any influence on the set-up and the content of any linked websites. We are not liable for any set-up and content of the referred websites. Any connections to these websites happen at the user’s own risk. WBProduction GmbH has the right to change and update the given information at any time. The content and structure of the World Bodypainting Festival website, the World Bodypainting Association and WB-Production GmbH are protected by copyright. The use of the website’s content, especially for commercial purposes, is prohibited.
3.1) Ticket order and booking of services
Tickets for the World Bodypainting Festival, the side events, and workshops can be purchased via the booking platform www.bodypainting-festival.com and via the online shop of WB-Production GmbH under the domain shop.wb-production.com. Any orders – incl. orders made via telephone or online – are binding and can not be changed or canceled. The fee is payable immediately due to limited places. All standard tickets are payable immediately and are 100% not refundable.
Cancellations of workshops have a 20% cancellation fee until 3 months before the event, 50% cancellation fee until 1 month before the event. Any cancellations 4 weeks or less prior to the event are not refundable.
3.2) Cancelling, Changes, Repayments
Retraction of the tickets (change or buyback) is not possible, except the show is canceled by the organizer OR in the event of an official cancellation by the government of the festival (for example by SARS-CoV-2) . In case of cancellation, tickets can be refunded, the refunding period ends two months after the scheduled show date. Tickets have to be returned in the same way as they were bought. (In case of purchase by other distribution channels these channels will announce relevant facts.) Changes in cast, program or data are subject to change to the organizer (venue), therefore refund is not possible. In case of absence of one or more bands at a show due to force majeure price reduction is impossible, as well as for a partly usability of the venue due to force majeure.
In case of cancellation that is not caused by the organizer or caused by an artist (eg music or show act), expenses like hotel, call-out fee, shipping expenses, administrative charges, etc. are not reimbursed, as well as for delays and changes in cast and program.
At television broadcasts, the owner of the ticket declares its approval to the broadcasting company to utilize video material taken on the festival that may show him/her. The recordings can be utilized without compensation with any currently technical method as well as with future techniques, without any temporal or spatial restriction. Due to the volume, the risk of hearing damages and damages to health is given at a concert; the organizer does not assume liability for those damages or any other personal injury or material damages.
4) Contract conclusion
On receipt of the order confirmation at WB-Production GmbH, a legal contract between the consumer and WB-Production GmbH is established.
5) Withdrawal from the contract
The withdrawal or changing of the tickets is not possible. No refund is made for lost, unused or only partially used tickets. Any withdrawal from this contract is excluded by law § 3 KSchG Konsumentenschutzgesetz Austria.
6 ) Payment / price
According to availability, the payment of the tickets and services (workshops) is made via the chosen system. The cleared amount includes the processing fee, the shipping costs and the legal fee for Austria. The ticket is valid only on full payment of the amount invoiced.
7) Ticket delivery
The tickets are either electronic tickets or will be sent out via email with a pixel code that can be used only once. Please change your e-ticket for an on-site ticket at the pre-sale counter at the entrance to the festival. Photo, VIP and any other special tickets will be prepared in advance and can be picked up on-site (guest list or VIP counter, side events entrance, …). Please note that the tickets are only handed out on presentation of a valid ID. Access to the workshops is only given on payment of the full workshop fee. The time and place of the workshops can be found in the workshop brochure or in the last newsletter prior to the event.

8) Right of rescission
Merchandise purchase, return and right of revocation (excluding tickets) Any purchase of merchandise via the online shop, especially books, photo data and sound carrier, is an obligatory purchase. The ordered article will be sent out to the address given after payment. The postal charges depend on the size and weight of the article. The right to return the article is under the legal assignment. If an article is returned, it has to be in the original packaging without any signs of usage. The reshipment occurs at the purchaser’s own expense, otherwise, there will be not accepted by the receiving party. A refund can be only made on the presentation of the original receipt. In case of resignation of the contract, a fee of EUR 10,- inside Austria and EUR 15,- outside Austria will be invoiced. The purchaser has the right to withdraw from the contract within 2 weeks from the date the purchase was made in a written form (i.e. via email, fax, …) without any reason or via reshipment of the article. The deadline starts after this information has been received. The revocation has to be carried out onto the following

Consequences of rescission
In case of revocation, both parties are forced to regrant the accomplishments received. Compensation for the lost value has to be safeguarded.
Cancellation of ticket orders
The right of revocation is not valid for any ticket orders.
8) Change of the event date
In case of any change in the event date, WBProduction GmbH reserves the right to contact the consumers that have purchased any services and have stated their contact details via email, telephone, post or via text message. Any changes in the program, date or performances do not allow any return of the tickets or any refund of the money paid.
9) Liability
In case of any invalid allegations when ordering the ticket online, the consumer is liable for any losses occurred. Clients who deliberately use the wrong information and support misusage will be excluded from the website www.bodypainting-festival.com and the event itself. WB-Production GmbH is liable in case of negligence only. In case of any misusage of the tickets (use of copies, changes of the tickets issued, …), WB-Production GmbH reserves the right to exclude the person from the event and to carry out legal steps against him/her.
10) Data privacy
The personal data given during the order process will be used by WB-Production GmbH for the conclusion of the contract only in the frame of the legal terms. The client agrees that the data given can be used for the marketing purposes of future events of WB-Production GmbH. The client will be notified that this acceptance can be revoked at any time. Further Information sees please below under the chapter General Data Protection Regulation.
11) Image recording at the events of WBProduction GmbH
The visitor agrees that pictures are made during the event. The pictures can be used after the event (photos, videos, TV, …). The visitor agrees that the pictures taken during the event can be used for any marketing purposes or commercial usage without any limitations of time and place as well as without any compensation.
12) Final clause
1. In the case of invalidity of certain parts of these terms, the validity of the rest is still given.
2. In regards to the sound intensity, WBProductionGmbH is not liable for any health damage caused.
3. The use of Austrian law only excluding the conflict rule is stated mutually.
Place of jurisdiction for company clients is in Klagenfurt and for consumers at the court in charge.

General Data Protection Regulation
1. Explanation
We are very delighted that you have shown interest in our enterprise. Data protection is of a particularly high priority for the management of the WB Production Gmbh. The use of the Internet pages of the WB Production Gmbh is possible without any indication of personal data; however, if a data subject wants to use special enterprise services via our website, processing of personal data could become necessary. For this reason, every data subject is free to transfer personal data to us via alternative means, e.g. by telephone.
2. Collection of general data and information
The data subject has the possibility to register on the website of the controller with the indication of personal data. Which personal data are transmitted to the controller is determined by the respective input mask used for the registration. The personal data entered by the data subject are collected and stored exclusively for internal use by the controller, and his purposes. Participants at events or other our provided services (such as workshops, competitions) require detailed information that is sent by electronic and post mail.
By registering on the website of the controller, the IP address—assigned by the Internet service provider (ISP) and used by the data subject—date, and time of the registration are also stored. The storage of this data takes place against the background that this is the only way to prevent the misuse of our services, and, if necessary, to make it possible to investigate committed offenses. Insofar, the storage of this data is necessary to secure the controller. This data is not passed on to third parties unless there is a statutory obligation to pass on the data, or if the transfer serves the aim of criminal prosecution.
The registration of the data subject, with the voluntary indication of personal data, is intended to enable the controller to offer the data subject contents or services that may only be offered to registered users due to the nature of the matter in question. Registered persons are free to change the personal data specified during the registration at any time, or to have them completely deleted from the data stock of the controller.
The data controller shall, at any time, provide information upon request to each data subject as to what personal data are stored about the data subject. Besides, the data controller shall correct or erase personal data at the request or indication of the data subject, insofar as there are no statutory storage obligations. A Data Protection Officer particularly designated in this data protection declaration, as well as the entirety of the controller’s employees are available to the data subject in this respect as contact persons.
3. Cookies
